Are you a qualified Social Worker, Occupational Therapist, Nurse or chartered Psychologist? Would you like to develop your skills and applied knowledge of the Mental Capacity Act and Deprivation of Liberty? If the answer is yes, then we have Best Interests Assessor (BIA) posts available which would offer an exciting career development opportunity for either a qualified Best Interests Assessor or a suitably qualified professional with 2 years post qualified experience who would like to undertake the specialist BIA training.The successful candidate will work across a number of regulated care provider settings and focus on completing high quality best interest assessments for people with high priority needs within current legal frameworks. With the implementation of the Mental Capacity (Amendment) Act on the horizon, this will be an exciting time to join a small but dedicated team and contribute to our planning and preparations for Liberty Protection Safeguards.As an integrated health and social care organisation, we will offer you the opportunity to work across a broad range settings that sit within adult social care, NHS Trust and CHC funded services. We will also fully support you in making the transition from Best Interest Assessor to Approved Mental Capacity Act Practitioner when training is available.
  • To support in the delivery of a high quality DoLS Service in accordance with the MCA 2005 and DoLS, the associated Codes of Practice, caselaw and Torbay and South Devon NHS Foundation Trust (TSDFT) policy and guidance
  • To work in ways that develop good working relations and collaborative arrangements with our Partners and key Stakeholders
  • To adopt an effective partnership approach with the Relevant Person, their families, involved professionals, Independent Mental Capacity Advocate (IMCA), Relevant Person Representatives (RPR), Managing Authorities (MA) and Mental Health Assessors (MHA)
  • To support in the coordination of the DoLS assessment from prioritisation of referrals, completion of assessments, identification of an appropriate level of Authoriser in order that completed assessments are presented to the Supervisory Body within agreed timescales
  • To undertake person centred and holistic Best Interest Assessments in accordance with the requirements of the MCA 2005, informed by the Codes of Practice, emerging case law and Human Rights
  • To gather and analyse complex information regarding individual risk factors and to make recommendations and set conditions to reduce restrictive measures ensuring arrangements in place are proportionate and necessary to protect the Relevant Person from harm and the seriousness of that harm in their best interests.
