Summary

Working as a Prosecutor in the East Midlands is exhilarating, based in one of our Magistrates’ Court, Crown Court or Complex Casework Units, you will work on a variety of cases across criminal offences, from murder and serious assault, to complex fraud or drug offences. Prosecutors in our Crown Courts will be responsible for making charging decisions in advance of prosecution as well as advocacy in Court, whilst those working in our Complex Casework Units lead on the area’s high-profile media cases.

Our Prosecutors are exposed to serious crime from the outset but are provided with the support and guidance they require. Working in this area brings with it the opportunity and duty to protect communities, friends, and families by bringing offenders to justice. We offer a range of support for our prosecutors to help them balance work and home. This will include flexible working hours, options to work from home for part of the week and flexibility to support caring responsibilities.

The CPS East Midlands region serves the counties of Derbyshire, Leicestershire, Lincolnshire, Northamptonshire, and Nottinghamshire, including the cities of Nottingham, Derby and Leicester and the county of Rutland. CPS East Midlands has two main office hubs in Nottingham and Leicester and two smaller satellite offices in Northampton and Lincoln.

Job description

Initially the postholder will work on the more straightforward cases but should progress quickly to deal with more serious casework. On completion of the Crown Prosecutor 5 Learning Stages the postholder will be able to advise police and other investigators (except Statutory pre- charge advice), and undertake Advocacy, review and case preparation in summary and either way matters heard in the magistrates’ court.

Subject to the postholder satisfying the “general qualification” provision within the meaning of section 71 of the Courts and Legal Services Act 1990, the post is designated by the Director of Public Prosecutions as a Crown Prosecutor under the terms of section 1 (3) of the Prosecution of Offences Act 1985.

Responsibilities

To advise police and other investigators (except Statutory pre-charge advice) in a range of preliminary, straightforward and contested casework including some either way cases. The postholder will prepare for prosecutions in summary and either way matters heard in the magistrates’ court.

To decide based on the evidence whether prosecutions should proceed or be discontinued in summary and either way matters heard in the magistrates’ court.

The postholder will require the ability to explain decisions to magistrates, counsel including defence, witnesses, the police and other appropriate agencies in a manner that is appropriate for the recipient.

To work effectively as part of a multi-skilled team and provide support to Associate Prosecutors, legal trainees and other Crown Prosecutors in case preparation and generally. The postholder will need to consider the needs of others, particularly victims and witnesses in drawing up casework plans.

Qualifications

Legally Qualified: The post holder must be a qualified practising solicitor or barrister and must hold a valid Practising Certificate for England and Wales.

Academic: Law degree, Common Professional Examination, Graduate Diploma in Law.

Professional: Legal Practice Course or Bar Professional Training Course and have completed the relevant pupillage and training contract (or have received full exemption from the relevant professional regulatory body, either the Solicitors Regulation Authority or the Bar Standards Board).

OR

CILEx: The post holder must be a Fellow of CILEx, and in addition be a CILEx Advocate/Litigator holding all three advocacy certificates providing them with a ‘general qualification’ within the meaning of s.71 (3) (c) Courts and Legal Services Act 1990. Therefore, the holder must have a right of audience in relation to any class of proceedings in any part of the Senior Courts, or all proceedings in county courts or magistrates’ courts in order to meet the requirements for a Crown Prosecutor specified by section 1 Prosecution of Offences Act 1985.

Memberships

The successful applicant must have a valid practising certificate for England and Wales or be eligible to obtain a valid practising certificate issued from either the Solicitors Regulation Authority or the Bar Standards Board.
