Overall SummaryA role within the Compliance advisory team, working closely with Close Brothers Asset Finance and Leasing (CBAFL) senior management to ensure regulatory and compliance risks are managed in a manner which preserves agreed risk appetite and supports business growth.
The key purpose of this role is to ensure the that CBAFL is provided with relevant advice and guidance to comply with regulatory requirements and/or industry standards, including those of the FCA, as applicable.
The role involves working with stakeholders across CBAFL, providing training on compliance initiatives, presenting in forums on relevant regulatory topics and providing general compliance advice to individuals across the department. The role also includes ensuring the business has appropriate policies and procedures in place whilst maintaining dialogue with key stakeholders to deliver good customer outcomes and support an appropriate ‘tone from the top.’
Products supported in this role include both regulated and unregulated lending (secured and unsecured products) sold in a variety of ways and insurance sales. Jurisdiction is primarily UK and Republic of Ireland. Some operations are outsourced.
Responsibilities
- Serve as the primary point of contact for compliance advisory services on a variety of topics, including changes to customer-facing documents, procedure reviews, product oversight, incentive schemes, third party oversight, complaints handling and vulnerable customers.
- Develop and maintain effective relationships with key stakeholders, including CBAFL management and the wider Compliance, Risk and Legal teams.
- Provide compliance support for senior stakeholders within the business.
- Provide regular reporting to the Commercial Risk and Compliance Committee (CRCC).
- Be an active participant in the CRCC, Customer Forums and Vulnerable Customer Forums, where applicable.
- As necessary provide separate briefings to the Divisional CEO and other leadership team on issues, regulatory development, monitoring findings, policy changes etc.
- Provide advice, guidance and support on regulatory requirements as required, in particular, CONC, DISP and CCA requirements for regulated lending.
- Identify and analyse regulatory developments, such as FCA publications, to interpret the impact to the business areas, conduct GAP analyses where appropriate.
- Review marketing material, financial promotions and customer communications in accordance with the regulatory rules for advertising to customers.
- Oversee the processes to maintain accurate records for regulatory and internal purposes (e.g. Conflicts of Interest, Rule Breaches, Gifts & Hospitality register), escalating activities outside of policy.
- Support CBAFL in its efforts to maintain a strong conduct risk culture.
- Oversee and manage direct reports to ensure compliance matters are appropriately handled and done so in a timely manner.
- Understand the CBAFL strategy and help ensure it is delivered in a manner which meets compliance obligations.
- Maintain effective relationships with key senior compliance stakeholders, in particular, Risk, Business Governance, and Finance.
- Participate actively in dialogue with sales, dealers and other third parties as necessary and identify appropriate solutions where issues emerge.
- Provide information for the Group Head of Operational Risk and Compliance and the Retail Operational Risk and Compliance Director on the compliance risks and issues that exist and are emerging in the business and how these are being mitigated.
- Provide review and challenge on the operation of first line of defence processes in the business that have specific regulatory obligations attached (e.g. Financial Promotions, Sanctions & PEP screening, Complaints)
- Developing Our People: as a line manager, you will be responsible for increasing productivity and developing performance through coaching, mentoring and developing your team members. You will encourage your team to take responsibility for their own personal development and provide support through regular feedback.
- Compliance/risk/governance/legal experience in a financial services role or from a consultancy background within a financial services practice.
- Experience navigating the FCA Handbook.
- Specific experience with FCA Handbook sections SYSC, CONC, DISP.
- Familiarity with CCA requirements for regulated lending.
- Able to analyse and interpret information from a regulatory and commercial perspective.
- Strong oral and written communication skills
- Strong judgement with regard to appropriate risk-based decision making and escalation
- Ability to influence and persuade senior stakeholders, using assertive language when appropriate.
- Excellent attention to detail
- Good understanding of conduct risk
- Ability to build strong relationship with senior managers.
- Experience of working in a business with an intermediated sales model.
- Specific experience within the asset finance and/or leasing industry or other similar lending businesses.
- Educated to degree or equivalent
- ICA Diploma in Governance, Risk and Compliance, CISI Reg & Comp or equivalent
