Petrofac is looking to recruit a Commercial Manager to join our Petrofac Facilities Management Limited on a permanent basis based in Aberdeen, UK.

Main Purpose Of The Role

Provide contractual and commercial support to senior management and the client to include managing contractual and commercial aspects of the contracts to maximise commercial performance and ensuring areas of contractual and commercial risk are identified and managed appropriately.

Key areas of focus being Projects both oil and gas and new energies projects.

Key Accountabilities
  • Ensuring the Project Directors and their teams are aware of and comply with their contractual obligations and monitoring compliance with the contract.
  • Provide direct contracts and commercial support to Project Director in the drafting and implementation of contract renewal, amendments and commercial strategies, with a focus on effective management of risk and delivery of maximum return within existing contracts.
  • To work with the bid teams and lead the commercial responses both pricing and contractual elements for tenders.
  • Manage and perform the review of contractual terms and conditions and their negotiation to ensure that the company liabilities and legal/contractual obligations are defined, communicated, and qualifications correctly incorporated into tender response.
  • Organize and lead (where appropriate) the commercial participation for Asset Solutions Service line RRC approval meetings to ensure compliance with corporate governance and provide an understanding of commercial aspects of our bid.
  • Ensuring where appropriate client, partner and subcontractor due diligence is undertaken,
  • Identifying, managing and reporting on key risks and issues
  • Managing contractual disputes and claims
  • Providing commercial input to the required processes regarding contract changes, approval of new opportunities etc.
  • Ensure service line compliance with Group DoA and RRC process.
  • Ensure that Contracting activity is in full compliance with company requirements with respect to Companies best practice guidelines
  • Manage subcontracts team in the drafting and negotiating of sub-contracts to ensure the flow down of contractual risk is implemented where applicable.
  • Contract administration responsibility for the commercial teams, including all rate reviews, contract reviews, amendments and incentive performance, etc. in order to ensure that all costs are fully recovered and are accounted for
  • Ensure collation and presentation of consolidated performance reporting and KPI measurement across all contracts such that individuals managers are provided with appropriate business and commercial information when making operational decisions.
  • Oversee the preparation of annual project budgets and re-forecasts and prepare consolidated annual divisional operational budgets and reforecasts in the service line
  • Ensuring that periodic contract audits and reviews are undertaken
  • Develop and sustain professional working relationships with clients and internal support functions
Skills & Experience
  • Degree qualified (preferably in Construction/Quantity Surveying/law)
  • Computer literate in Microsoft Office especially Excel
  • Commercial contracts experience
  • Experience within a Projects environment
  • Leadership/Supervisory experience and team working skills.
  • drafting and negotiating skills (terms and conditions and contract schedules)
  • Ideally experience using one or more of LOGIC, FIDIC, IChemE, NEC forms of contracts
